NPDES Phase II Municipal Stormwater Permit Program

Background

The NPDES Phase II Municipal Stormwater Permit for Western Washington was issued by the Department of Ecology in January of 2007 and went into effect in February.  The permit requires that all affected municipalities create and implement a Stormwater Management Program (SWMP) which addresses five required program elements: 1) Public Education and Outreach, 2) Public Involvement and Participation, 3) Illicit Discharge Detection and Elimination, 4) Construction Site Run-Off, 5) Operations and Maintenance of Post Construction Stormwater Facilities.  While the Permit went into effect in February of 2007, the permit itself phases program implementation requirements out over the next four years. 

What is NPDES?

The National Pollutant Discharge Elimination System (NPDES) is a federal permit that regulates stormwater and wastewater discharges to waters of the State.  While it is a federal permit, the regulatory authority has been passed to Washington State Department of Ecology (DOE).

The City of Federal Way is requesting public review and comment on the documents listed below.  These documents have been prepared in compliance with the Western Washington Phase II Municipal Stormwater Permit.  The Annual Report and SWMP documents will be updated annually to addressed the additional phased permit requirements as they come into effect.  Please direct comments to hollie.shilley@cityoffederalway.com.

Public Meetings

February 16, 2010 -SWM staff intends to present the NPDES Annual Report and Stormwater Management Program documents to City Council for approval pending approval by LUTC.

February 1, 2010 - SWM staff will present the NPDES Annual Report (covering 2009) and the updated Stormwater Management Program to the Land Use and Transportation Committee (LUTC).  The meeting will also include a brief presentation on the status of NPDES permit compliance.  The meeting is held in City Hall Council Chambers at 5:30 PM.   

July 7, 2009 - 1st reading of proposed ordinance to meet NPDES requirements.

June 15, 2009 - SWM staff will present the proposed NPDES Code Amendments including stormwater manual adoption to the Land Use and Transportation Committee during Public Hearing. 

May 20, 2009 - SWM staff presented the proposed NPDES Code Amendments including stormwater manual adoption to the Planning Commission during Public Hearing.  Comments were submitted by the development community.

May 6, 2009 - SWM staff presented the proposed NPDES Code Amendments including stormwater manual adoption to the Planning Commission in Study Session. 

March 17, 2009 - SWM staff presented the NPDES Annual Report and Stormwater Management Program documents to City Council for approval.  No comments were recieved.  Council approved both documents for submittal to the Department of Ecology.

March 2, 2009 - SWM staff presented the NPDES Annual Report (covering 2008) and the updated Stormwater Management Program to the Land Use and Transportation Committee (LUTC).  The meeting also include a brief presentation on the status of NPDES permit compliance.  The meeting was held in City Hall Council Chambers and started at 5:30 PM.  There was no public comment.  LUTC forwarded the documents to City Council with a recommendation for approval.   

November 13, 2008 - SWM staff briefed the Permit Stakeholders' Group during a public meeting in Council Chambers on pending changes resulting from NPDES requirements, including the adoption of the new (2009) King Surface Water Design Manual and code revisions to allow for and encourage the use of Low Impact Development (LID) techniques.   SWM staff also requested comments on proposed incentives for the use of LID and proposed limitations on the use of LID.

September 8, 2008 - SWM staff updated City Council's Land Use and Transportation Committee (LUTC) on the Puget Sound Partnership grant to create recommendations on how to integrate Low Impact Development (LID) Techniques into City regulations.   The recommendations are intended to allow, but not require the use of LID in development projects.  To learn more about LID and the status of the LID grant, please review the September 8th, 2008 presentation to LUTC.  LUTC recommended approval of staff recommendations 9/8/08, with the condition that staff bring the development industry into the process.   City Council approved staff recommendations on 9/16/08.

March 18, 2008 - The NPDES Annual Report and Draft Stormwater Management Program documents were presented to and approved by City Counil.

March 3, 2008 - SWM staff presented the NPDES Annual Report and Draft Stormwater Management Program documents to the Land Use and Transportation Committee (LUTC).   The presentation also provided information on the permit requirements, as well as what has been accomplished so far and what remains to be completed.  The documents were forwarded to City Council with a recommendation for approval from LUTC.

October 11th, 2007 - Surface Water Management (SWM) held its first NPDES Public Meeting  in City Hall Council Chambers from 6 to 8 PM.  The meeting provided an overview of SWM's existing programs and the NPDES requirements/process, as well as identified ways the public can participate in the update of our Stormwater Management Program (SWMP).  To view the Power Point Presentation click here.

 


NPDES Permit Compliance Status

A Notice of Intent (NOI) to comply with the NPDES Phase II Western Washington Municipal Stormwater Permit was sent to DOE in February 2007 and two public notices were posted in the local newspaper (The Federal Way Mirror) per the permit requirements.

A Notice of Coverage letter was received from DOE in March of 2007 identifying that the City was now covered under Permit No. WAR 04 -5516.

Public Participation - The City encourages public comment and participation in the development and implementation of the SWMP throughout the four year process.  The City is utilizing the following venues in an effort to keep our residents informed on the progress of the SWMP, so they can provide comments and input as the SWMP develops:  1) This web page; 2) The quarterly Surface Water Management newsletter - The Water Log; 3) Public Notices in the Federal Way Mirror; and 4) Public Meetings – Open Houses/Workshops and City Council Meetings.

In addition, NPDES updates will be given and comments solicited from the Permit Process Stakeholders Group during their annual meeting with City Staff, beginning in November of 2008.

Existing Programs - The City of Federal Way Surface Water Management Utility (SWM) is well established with an existing surface water utility rate structure and many of the NPDES Phase II Permit program elements already in place.
