All bid proposals shall be in accordance with the Contract and all bid proposals shall be accompanied by a bid deposit or bond in the amount required in the Contract. Forfeiture of the proposed bond or deposit to the City shall be in accordance with the Contract.
The City, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49 C.F.R., Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises as defined at 49 CFR Part 26 will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, or sex in consideration for an award. The City encourages minority and women-owned firms to submit bids consistent with the Cityβs policy to ensure that such firms are afforded the maximum practicable opportunity to compete for and obtain public contracts.
The City of Federal Way reserves the right to reject any and all bids, waive any informalities or minor irregularities in the bidding, and determine which bid or bidder meets the criteria set forth in the bid documents.
This project shall consist of: Furnishing all materials, equipment, tools, labor, and other work or items incidental thereto (excepting any materials, equipment, utilities, or service, if any, specified herein to be furnished by the Owner or others), for the construction, sequencing, and traffic control plan for overlaying existing asphalt concrete pavement in eight (8) different locations within the City of Federal Way. The work shall include but is not limited to Hot Mix Asphalt (HMA Cl. Β½β PG 58H-22) pavement overlay (approximately 13,750 tons), roadway excavation, planning bituminous pavement, pavement repair, removal and replacement of curb and gutter, sidewalk, curb ramps, traffic curb, repairing or re-aligning manholes and catch basins, traffic signal detection loops, pedestrian push button and foundation, channelization, restoration, utility adjustments, and all items necessary to complete the work as described in the Contract Documents.
The City anticipates awarding this project to the successful bidder and intends to give the Notice to Proceed as soon as the Contract and all required documents are executed in full. Regardless of the date of award or Notice to Proceed, the Contractor must complete all work within 110 working days.
